1. Purpose and Scope
These Terms of Use (the "Terms of Use") govern access to, browsing and use of the official website relating to Carlos Sainz, including its sections, language versions, content, forms and associated digital services made available from time to time (the "Website").
The Website is operated by SAIVA MANAGEMENT, S.L. ("SAIVA") and combines corporate, sporting, informational and audiovisual content with e-commerce, subscription, contact and back-in-stock notification features, partner content and, where applicable, information about or access to experiences and events.
These Terms of Use supplement the Legal Notice and apply without prejudice to the Privacy Policy, Cookie Policy, Terms and Conditions of Sale and any specific terms that may apply to a particular feature, product, event, campaign or service. Purchases made through the online store are specifically governed by the Terms and Conditions of Sale.
2. Website Operator
SAIVA MANAGEMENT, S.L., with Spanish tax identification number (NIF) B88091640 and registered office at Calle Bruselas, 3, 28232 Las Rozas de Madrid (Madrid), Spain, is the owner and operator of the Website and the seller of the products offered through the online store, without prejudice to the involvement of technology, logistics, payment, transport, content and support providers.

3. Access, Awareness and Acceptance
Access to the public sections of the Website does not require express contractual acceptance of these Terms of Use. However, users must comply with the rules of use set out in these Terms from the moment they access or use the Website.
Where a specific feature requires an affirmative action, acceptance of specific terms or the conclusion of a contract, SAIVA will provide the relevant information before the user becomes bound.
Under the launch configuration currently planned, the Website does not include user account creation or a "My Account" area. If a registration or user profile feature is introduced in the future, SAIVA will update the applicable terms and information before activation where necessary.
4. Capacity and Use by Minors
The Website may be viewed by users of different ages. However, in order to carry out actions producing legal effects, including purchasing products, users must have sufficient legal capacity or act with any assistance or representation required by applicable law.
Minors should use the Website under the supervision of their parents, guardians or legal representatives and should not provide personal data or make purchases where they cannot validly do so under applicable law. Capacity requirements relating to purchases are further addressed in the Terms and Conditions of Sale.
5. Availability, Continuity and Website Changes
SAIVA will seek to keep the Website available, secure and up to date. However, continuous and uninterrupted availability cannot be guaranteed, as access may be suspended, limited or interrupted due to maintenance, updates, security, technical incidents, force majeure, provider actions or compliance with legal obligations.
SAIVA may change the structure, design, presentation, content or functionality of the Website in response to technical, operational, legal or commercial needs, while respecting rights already acquired and contractual obligations already assumed towards users.
6. General User Obligations
Users must use the Website lawfully, diligently, responsibly and in good faith, in accordance with these Terms of Use and applicable law.
In particular, users must:
- provide truthful, accurate and up-to-date information when using forms, subscribing to a service, requesting support or making a purchase;
- use each feature only for the purpose for which it has been made available;
- respect the rights of SAIVA, Carlos Sainz, partners, providers and other third parties;
- take reasonable steps to protect their devices and communications; and
- follow reasonable security, support, purchase, return or use instructions displayed on the Website.
7. Prohibited Use
The Website may not be used in breach of the law, these Terms of Use or the legitimate rights and interests of SAIVA or third parties. In particular, users must not:
- access or attempt to access systems, restricted areas, data, resources or features without authorisation;
- impersonate another person or entity, falsely represent an affiliation with a third party or provide fraudulent information;
- introduce, transmit or use malware, harmful code, exploitation tools, abusive loads or other elements intended to compromise the security, integrity or availability of the Website;
- circumvent, disable, manipulate or test without authorisation any security, authentication, access-control or traffic-limitation measure;
- improperly interfere with the operation of the Website, purchasing processes, availability of limited units or services used by other users;
- carry out unauthorised bulk extraction, scraping, crawling, data mining, indexing or automated access involving Website content or databases, except to the extent a mandatory legal authorisation applies or the relevant rights holder has expressly authorised it;
- reproduce, distribute, communicate to the public, transform, resell or exploit Website content beyond uses permitted by law or expressly authorised; or
- use the Website for fraudulent, unlawful, misleading, defamatory, discriminatory, violent or privacy-invasive purposes or in a manner that infringes third-party rights.
These restrictions must be interpreted proportionately and do not limit any rights, exceptions or uses that are mandatorily recognised by applicable law.
8. Forms, Contact and Customer Support
The Website may include forms and channels for enquiries, support requests, order management, returns or warranty matters, incident reporting or the exercise of rights. Users should provide only the information needed for the relevant purpose and should avoid including third-party data or particularly sensitive information unless strictly necessary.
The customer support channel currently planned is support@carlossainz.es. Privacy and data-protection enquiries are governed by the Privacy Policy and may be sent through the channels identified there.
9. Newsletter, Communications and Back-in-Stock Notifications
Users may voluntarily subscribe to marketing communications relating to Carlos Sainz using the mechanisms provided. Subscription, withdrawal, preferences and related processing are governed by the Privacy Policy and applicable electronic-marketing rules.
A "Back-in-Stock" notification is a specific service requested by the user in order to receive an alert about a particular product. Requesting such an alert does not, by itself, subscribe the user to the general newsletter or reserve a unit of the product, unless expressly stated otherwise.
Strictly transactional communications relating to an order, payment, dispatch, delivery, incident or pre-order are used to manage the requested relationship and should not be confused with voluntary marketing communications.
10. Online Store and Purchases
Browsing the online store does not oblige users to make a purchase. The sale of products, including pre-orders, limited units, collectibles and high-value items, is governed by the Terms and Conditions of Sale and by the pre-contract information displayed on product pages and during checkout.
Rules on prices, taxes, payment methods, dispatch, delivery, withdrawal, returns, refunds, lack of conformity, warranties and any specific procedures applicable to Vault or high-value items are set out in the Terms and Conditions of Sale and, where relevant, in specific information displayed before the purchase is completed.
11. Partner Content, Links and Third-Party Websites
The Website may include content, references or links relating to sponsors, partners, promoters or other third parties. The inclusion of a link or reference does not mean that SAIVA controls the third party's services, policies, terms or content beyond any collaboration expressly identified.
When users leave the Website and access a third-party environment, that third party's own terms and policies will apply. SAIVA is not responsible for third-party acts, content or services outside its effective control, without prejudice to liabilities that cannot legally be excluded.
Under the configuration currently communicated, the partner page forms part of the Website's own content and does not include tracking implemented directly by partners. This may be reviewed if the technical configuration changes.
12. Events, Experiences and Redirections to Promoters
The Website may communicate or allow users to express interest in events, experiences, meet-and-greets, partner activities or other initiatives relating to Carlos Sainz. The specific conditions will depend on the party organising and managing each activity.
Where SAIVA directly organises an activity, the relevant specific information will be provided before registration or purchase. Where an activity is organised and sold by a partner or promoter, the Website may be limited to providing information or redirecting the user to the third party's environment, and that third party will be responsible for its own contractual terms and applicable information.
The publication of information about an event does not guarantee the availability of tickets, places, invitations or experiences unless expressly stated otherwise.
13. Sporting Information, Video and Third-Party Content
Certain sporting data, schedules, results, statistics, audiovisual content or embedded elements may be supplied by external providers, including sports-data or video-hosting services. Such content is primarily provided for information and may be subject to updates, delays, incidents or changes at source.
SAIVA will seek to correct relevant errors brought to its attention but does not guarantee that third-party sporting information will be updated in real time or that external services will remain permanently available, unless a specific contractual or legal obligation applies.
14. Intellectual Property, Industrial Property and Image Rights
The Website and its components, including its structure, design, code, databases, text, photographs, video, audio, illustrations, graphics, interfaces, catalogues, product pages, trade marks, logos and other distinctive signs or content, are protected by intellectual-property, industrial-property, image-rights and other applicable laws.
Rights in those elements belong to SAIVA, Carlos Sainz or their respective legitimate rights holders, licensors or assignees. Access to the Website does not constitute an assignment, transfer or general licence of those rights.
In particular, the name, image, voice, signature, identity, trade marks and other attributes associated with Carlos Sainz may not be used to falsely suggest sponsorship, collaboration, endorsement, licensing or a commercial relationship, or otherwise exploited commercially without the appropriate authorisation.
Users may view and use the Website for personal and legitimate purposes inherent in browsing and using the services provided. Any other use must comply with applicable statutory limits and exceptions and, where required, be authorised by the relevant rights holder.
15. Privacy and Cookies
Personal-data processing arising from use of the Website is governed by the Privacy Policy. The use of cookies, pixels, tags, identifiers and similar technologies is explained in the Cookie Policy and managed through the consent mechanism provided where consent is legally required.
Acceptance of these Terms of Use does not constitute consent for marketing purposes or for non-essential technologies that require separate authorisation.
16. Accessibility
SAIVA works to make the Website usable by as many people as possible and may use technological solutions to support accessibility. If a user encounters a barrier preventing access to information or use of a feature, it may be reported to support@carlossainz.es for review.
The use of third-party accessibility support tools does not constitute a guarantee of absolute compatibility with all devices, assistive technologies or configurations, without prejudice to applicable statutory accessibility obligations.
17. Security and Protective Measures
SAIVA and its providers apply reasonable measures intended to protect the security, availability and integrity of the Website. However, no Internet-connected system can be considered completely immune from incidents or malicious activity.
SAIVA may take proportionate measures to block or temporarily restrict access, requests, transactions or features where there are reasonable indications of fraud, abuse, unauthorised automation, security risk, breach of these Terms of Use or a need to comply with a legal obligation.
Such measures will not unjustifiably affect rights already acquired by users and, where possible and appropriate, a channel will be made available to clarify the incident.
18. Liability
SAIVA is responsible for complying with the obligations imposed on it by applicable law and for contractual relationships it enters into with users.
Without prejudice to the above, SAIVA is not liable for damage arising exclusively from unlawful or negligent acts of a user, use of the Website in breach of these Terms, external services outside SAIVA's effective control, technical incompatibilities not attributable to SAIVA or force-majeure circumstances.
No exclusion or limitation in these Terms applies where it would conflict with mandatory law, statutory consumer rights or liabilities that may not legally be excluded or limited by contract.
19. Changes to these Terms
SAIVA may amend these Terms of Use to reflect legal, technical, operational or functional changes. The current version will be made available on the Website together with its last-updated date.
Changes will not retrospectively alter contractual relationships already concluded unless they are favourable to the user, required by law or may otherwise validly apply under the relevant legal rules.
20. Severability and No Waiver
If any provision of these Terms of Use is held to be void, invalid or unenforceable, that will not affect the remaining provisions, which will continue to apply to the extent permitted by law.
A failure to exercise a right or remedy immediately does not constitute a waiver unless the waiver is express and unequivocal.
21. Language
These Terms of Use will be published in Spanish and English. Both versions have been prepared to reflect legally equivalent content.
In the event of an interpretative discrepancy between the two versions, the Spanish version will prevail, without prejudice to any mandatory rules and rights applicable to the user.
22. Governing Law and Jurisdiction
These Terms of Use are governed by Spanish law, without prejudice to any mandatory rules applicable to the user and, in particular, any rights available to consumers under the law of their place of residence where applicable.
Where the user is a consumer, disputes will be submitted to the courts having jurisdiction under applicable law, without waiver of any mandatory forum. In relationships not subject to mandatory consumer-protection rules, the parties submit, where legally permitted, to the courts of Madrid, Spain.
